End User License Agreement

This End User License Agreement (“EULA”) is a contract between Lukas Elias Rehfus, Derfflingerstraße 21, 10785 Berlin (“Licensor”, “we”) and you (“you”, the “Licensee”).

This EULA governs your use of the proprietary portions of the Reconstrura desktop software and updates provided under this EULA (the “Software”). Third-party software, libraries, models, weights, fonts and other materials included with or obtained for use with the Software (“Third-Party Components”) are governed by Section 6 and their respective license terms. By clicking accept, installing or using the Software, you accept this EULA.

1. License grant

Upon purchase and activation of a valid license key, Licensor grants you a personal, worldwide, non-exclusive, non-sublicensable, non-transferable license to install and use the Software for personal and commercial purposes, except where applicable law provides otherwise. The outputs you create with the Software (point clouds, datasets, Gaussian Splats, renders) are yours; Licensor claims no rights in them, and this EULA does not require attribution to Licensor. Ownership of an output does not by itself permit commercial use of an output created during the free trial; the commercial-use conditions in Section 3 apply. You remain responsible for ensuring that your inputs and use of the outputs comply with applicable law and third-party rights.

Licensor retains all right, title and interest in the proprietary portions of the Software. No rights are granted in those portions except for the license expressly stated in this EULA. Rights and ownership in Third-Party Components are governed by Section 6 and their respective license terms.

2. Device limit

One license may be activated on up to 3 devices simultaneously (a rolling limit): activating a 4th device automatically deactivates the least recently used one. You may also release a device manually in the app. Activations are bound to a pseudonymized, hashed device identifier; see the privacy policy.

3. Free trial

The Software offers a one-time 3-day free trial per device, started explicitly from within the app. The trial registers a pseudonymized hashed device identifier with our license server to enforce the one-trial-per-device limit, including across reinstalls.

The free trial provides the full Software functionality solely for evaluation, testing and other non-commercial use. You may evaluate the Software on behalf of a business, but you must not use the trial or any output created during the trial in production, deliver it to a client, sell, license or monetize it, use it in advertising or promotion, or otherwise exploit it for direct or indirect commercial benefit.

Commercial use of a Gaussian Splat (“Splat”) created with the Software, or of any render, export or other work derived from that Splat, is permitted only if the Splat was created while a valid purchased Reconstrura license was active for the Software. Purchasing or activating a license later does not retroactively authorize commercial use of a Splat created during the free trial. To use that scene commercially, you must create a new Splat from the source material while a valid purchased license is active. This condition does not transfer ownership of your inputs or outputs to Licensor.

After the trial expires, continued use of the proprietary Software requires a purchased license key.

4. Updates

All updates to the Software are included in the one-time purchase price, permanently. There are no upgrade fees and no subscription. Updates are provided when and as released; Licensor does not promise specific future features. Statutory update-obligation rights (e.g. §§ 327f BGB for consumers in Germany) remain unaffected.

5. Restrictions on the proprietary Software

Except as expressly permitted by Section 6, applicable third-party license terms or applicable law, you must not:

Nothing in this Section restricts acts that applicable law permits despite a contractual restriction, including statutory rights concerning intended use, error correction, backup copies, observation, study or testing, and interoperability. Nothing in this Section restricts any right granted for a Third-Party Component under Section 6.

6. Third-party and open-source components

Third-Party Components are licensed directly under their respective license terms, not under this EULA. Those terms apply to the relevant Third-Party Component even when it is bundled with, downloaded by, linked with or used by the Software. If this EULA conflicts with a third-party license, the third-party license controls solely for the relevant Third-Party Component.

The restrictions, device limit, proprietary license-key requirements and termination provisions in this EULA do not limit rights granted by a third-party license. You may exercise all rights granted by those terms, including, where applicable, rights to run, copy, study, modify, debug, reverse engineer, replace, relink or redistribute the Third-Party Component.

For components licensed under the GNU Lesser General Public License (LGPL), you may in particular:

These permissions do not extend to the proprietary portions of the Software except where an applicable third-party license or applicable law expressly requires or permits them.

The applicable notices and license texts are installed under assets/THIRD_PARTY_LICENSES. That directory also contains the generated NOTICES.txt and SBOM.cdx.json inventories and LGPL-WRITTEN-OFFER.txt, which provides source-code and replacement information for the LGPL components distributed with Reconstrura.

On first run, the Software downloads a GPU compute runtime and core models (approximately 2.4–4.0 GB, depending on the operating system and selected GPU compatibility tier) consisting of Third-Party Components. The installed runtime occupies approximately 6–7 GB.

7. Purchase, reseller, refunds

Purchases are processed by Polar Software Inc. as Merchant of Record (reseller). Polar handles checkout, invoicing, VAT and refunds; your purchase contract for the transaction is with Polar, while this license is granted directly by Licensor to you. To exercise a right of withdrawal, use the Request a refund form or email support@reconstrura.com. Polar processes the declaration in accordance with applicable law and its buyer terms. Statutory rights concerning defective digital products remain unaffected.

8. Privacy

Footage and photos you process never leave your device. The Software contacts Licensor’s servers only for trial start, license activation and periodic revalidation, and update checks, as described in the privacy policy. It may also contact third-party hosting services to obtain runtime dependencies, models or updates requested by the Software. Those downloads do not include your footage or photos.

9. Warranty and liability

For consumers: your statutory warranty rights (e.g. §§ 327 ff. BGB for digital products purchased in the EU) apply and are not limited by this EULA.

To the extent permitted by applicable law (and, for consumers, only insofar as statutory rights are not thereby restricted): the Software is provided “as is” without warranties beyond those required by law; Licensor is liable without limitation for intent and gross negligence and for injury to life, body or health, and otherwise only for the breach of essential contractual obligations (cardinal duties), limited to the foreseeable damage typical for this type of contract. Reconstruction quality depends on your footage and hardware; no specific result is warranted.

Third-Party Components are subject to any warranty terms and disclaimers in their own licenses.

10. Termination

This EULA runs for the duration of your use of the Software. Licensor may terminate the proprietary Software license and revoke the license key if you materially breach this EULA (in particular Section 5) and, where remediable, fail to remedy the breach within a reasonable period after notice. Upon termination you must stop using and delete copies of the proprietary Software. Your outputs remain yours, subject to Section 3’s continuing commercial-use condition for trial-created Splats. Termination of this EULA does not terminate, reduce or otherwise affect rights you received for Third-Party Components under their own license terms. Section 3 (solely as to trial-created outputs) and Sections 6, 9, 11 and 12 survive termination.

11. Governing law

This EULA is governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, the mandatory consumer-protection provisions of the country of your habitual residence remain applicable.

12. Severability

Should individual provisions of this EULA be or become invalid, the validity of the remaining provisions remains unaffected.
